VERKKOKAUPAN YLEISET SOPIMUSEHDOT

Soveltamisala

Esko Reiners Motorsport verkkokauppa on Esko Reiners Motorsport ylläpitämä markkinapaikka, jossa hyödykkeiden myyjänä on Esko Reiners Motorsport Oy (y-tunnus 265 7899-4). Näitä sopimusehtoja sovelletaan Esko Reiners Motorsport Oy:n (jatkossa ERM; Myyjä) ja näiden asiakkaiden välisessä kauppasuhteessa asiakkaan tilatessa Esko Reiners Motorsport verkkokaupasta.

Ehtoja sovelletaan myös asiakkaan tilatessa puhelimella, kirjeitse tai muuta etäviestintä käyttäen ERM tuotteita.

Hinnat

Verkkokaupan hinnat ovat voimassa toistaiseksi. Hinnat sisältävät ALV:N 24% ellei toisin mainita. Arvonlisäverokanta muuttuu lainsäädännön muuttuessa.

Ulkomaille toimitettavat tilaukset ovat yrityksille, yhteisöille ja yhdistyksille, sekä EU:n ulkopuolella oleville kuluttajille, arvonlisäverovapaita (VAT 0%). EU:n ulkopuolelle tapahtuvassa toimituksessa on vastaanottaja aina itse vastuussa kaikista veroista, tulleista ja muista maksuista tavaran vastaanoton yhteydessä.

Toimitustapa

Tilauksen toimitusaika on Suomessa yleensä 1–5 arkipäivää, mikäli toimitusaika on tätä pidempi, otamme yhteyttä tilaajaan. Ulkomaille toimitusaika on pidempi.

Tilaukset toimitetaan Suomessa DHL:n kotimaan palvelun ja ulkomaille DHL Expressillä tai DHL Economy Selectillä.

Lakko, työsulku, tulipalo, konerikko, raaka-aineiden puute, viranomaistoimenpide tai muu myyjästä riippumaton ylivoimainen este vapauttaa noudattamasta sovittua toimitusaikaa. Tilaajalla ei ole oikeutta vaatia tämän johdosta vahingonkorvausta.

Saatavuus

Tuotteiden saatavuus verkkokaupassamme voi vaihdella. Toisinaan tuotteet saattavat esimerkiksi tuotannollisten syiden vuoksi olla tilapäisesti loppuunmyyty. Mikäli tilattu tuote on tilapäisesti loppunut, pyrimme ilmoittamaan tämän asiakkaalle välittömästi tilanteen havaittuamme.

Maksutavat

Tilauksen voi maksaa ennakkoon verkkopankin välityksellä, luottokortilla ja Paypalilla. Kansainväliset tilaukset on maksettava joko luottokortilla, Paypalilla tai pankkisiirrolla.

Toimituskulut

Toimituskulut lisätään tilauksen loppusummaan. Toimituskulut määräytyvät toimituspaikan ja tilauksen koon mukaan.

Peruutusoikeus ja palautukset

Kuluttaja-asiakkaalla on oikeus tutustua tuotteisiin 14 päivän ajan tilauksen vastaanottamisesta. Palautettavan tuotteen on oltava samassa kunnossa kuin missä se toimitettiin.

Palautuksista on aina sovittava etukäteen verkkokaupan asiakaspalvelun kanssa. Kuluttaja-asiakas, milloin palautus ei ole toimitettavissa tavanomaisin tavoin postitse ja yritysasiakas vastaa palautuksesta aiheutuvista kustannuksista, ellei syynä ole tuotteen valmistusvirhe tai ERM verkkokaupan toiminnasta johtuva virhe.

Kansainväliset palautukset: asiakas vastaa aina kaikista palautuksesta aiheutuvista kustannuksista ja riskeistä, myös siinä tapauksessa, että lähetys katoaa.

Poikkeukset peruutusoikeudesta

Osalla tuotteista ei ole kuluttajansuojalain mukaista palautusoikeutta asiakkaan hyväksyttyä tilauksen. Rajoitus perustuu kuluttajansuojalain 6 luvun 16 §:ään.

Reklamaatiot

Asiakkaan tulee tarkastaa toimitus välittömästi vastaanotettuaan sen. Mahdollisista virheistä on ilmoitettava viipymättä kuitenkin viimeistään 7 päivän kuluessa ERM asiakaspalveluun.

Tilauksiin tai laskutukseen liittyvistä virheistä on ilmoitettava ERM asiakaspalveluun.

ERM ei vastaa tuotteen ja/tai toimituksen viivästymisestä tai virheestä aiheutuneista välillisistä vahingoista. Vastuu tavaraan kohdistuvasta vahingosta siirtyy luovutushetkellä tilaajalle.

Asiakasrekisteri

Verkkokaupan asiakkaiden nimi- ja yhteystiedot tallennetaan ERM asiakasrekisteriin. Rekisterin tietoja käytetään rekisteriselosteessa kerrotulla tavalla. Rekisteriselosteen voi myös pyytää ERM asiakaspalvelusta. Asiakkaalla on oikeus tarkastaa rekisteriin tallennetut tiedot. Tarkastaminen on maksutonta kerran vuodessa. Kuluttaja-asiakas voi kieltää henkilötietojensa käytön suoramarkkinointiin.

Muut sovellettavat ehdot

Yksittäisiin tuotteisiin voi liittyä erityisiä ehtoja, jotka on mainittu tuotteen esittelyn yhteydessä verkkokaupassa. Tuotekohtaisia ehtoja sovelletaan ensisijaisesti kyseisen tuotteen kauppaan, jos tuotekohtaiset ehdot ja Etäkaupan yleiset ehdot ovat keskenään ristiriidassa.

Voimassaolo

Nämä sopimusehdot ovat voimassa toistaiseksi. ERM:llä on oikeus muuttaa näitä sopimusehtoja. Muutoksesta ilmoitetaan ERM Internet-sivuilla.

Sovellettava laki ja erimielisyydet

Tähän sopimukseen sovelletaan Suomen lakia. Mahdolliset erimielisyydet ratkaistaan Keski-Suomen käräjäoikeudessa.

GENERAL TERMS & CONDITIONS OF THE ONLINE TRADE

Esko Reiners Motorsport online store is a marketplace operated by Esko Reiners Motorsport Oy, where the goods are sold by Esko Reiners Motorsport Oy (VAT No. FI26578994). These terms and conditions apply to Esko Reiners Motorsport Oy (hereinafter ERM; seller) and the commercial relationship between the customers who order from Esko Reiners Motorsport online store.

The terms and conditions also apply when the customer orders by phone, e-mail, letter or other distance communication ERM products.

Prices

The online-shop prices are valid until further notice. Prices include VAT 24% unless otherwise stated. The VAT rate will change as the legislation changes.

Orders shipped abroad to companies (a valid VAT number is required), as well as to consumers outside the EU, VAT-free (VAT 0%). In the case of delivery outside the EU, the recipient is always responsible for all taxes, duties and other charges when receiving the goods.

Delivery method

The delivery time of the order in Finland is usually 1–5 business days, if the delivery time is longer, we will contact the customer. The delivery time abroad is longer (the approximate transit time is indicated in the shipping methods).

Orders are delivered in Finland through DHL's domestic service and abroad via DHL Express or DHL Economy Select.

Strike, lockout, fire, breakdown, shortage of raw materials, official intervention or other force majeure beyond the control of the seller release ERM from the obligation to meet the agreed delivery time. The purchaser is not entitled to assert claims for damages as a result.

Availability

The availability of products in our online store may vary. Sometimes, for example, products may be temporarily sold out for production reasons. If the ordered product has temporarily expired, we will endeavour to inform the customer immediately after the situation has been detected.

Payment methods

The order can be paid (in Finland) in advance via online banking, credit card and PayPal. International orders must be paid by credit card, PayPal or bank transfer.

Shipping

Shipping costs are added to the order total. Shipping costs are determined by the delivery location and the size of the order.

Right of withdrawal and refunds

The private customer has the right to return the purchased product(s) within 14 days after receiving the order. The returned product must be in the same condition as it was delivered. Returns must always be agreed in advance with the ERM online store customer service. The customer bears the cost of returning the product and is always responsible for all costs and risks of the return, even if the shipment is lost, unless the defect in the product is due to manufacturing or to an error made by the seller in the online transaction.

Exceptions to the right of withdrawal

Some products do not have a right to return under the Consumer Protection Act after the Customer has accepted the order. The restriction is based on Chapter 6, §16 of the Consumer Code.

Complaints

The customer must check the delivery immediately upon receipt of it.

Errors related to orders or invoicing must be reported to the ERM Customer Service.

ERM is not responsible for any indirect damages caused by delay or error in the product and/or delivery. Liability for damage to the goods is transferred to the customer at the time of delivery.

Customer register

The name and contact information of online-store customers are stored in the ERM customer register. The data in the register shall be used as described in the privacy policy. The privacy policy can also be requested from the ERM customer service. The private customer has the right to inspect the data stored in the register. Inspection is free of charge once a year. The private customer may prohibit the use of their personal data for direct marketing purposes.

Other applicable conditions

Individual products may be subject to special conditions mentioned in the online store when the product is presented. Product-specific terms apply primarily to trade in the product in question in the event of a conflict between the product-specific terms and the General Terms and Conditions of online trade.

Validity

These terms and conditions shall be valid until further notice. ERM has the right to amend these terms and conditions. The change will be announced on the ERM website.

Applicable law and disputes

This agreement shall be governed by the laws of Finland. Any disputes will be settled in the District Court of Central Finland.
